In California, the Labor Code entitles employees to certain protection. At the most basic level, employees are entitled to the following rights:

    1. An employee is entitled to minimum wage. In California, the rate is currently $15.50 an hour, but some cities like Los Angeles or Santa Monica have passed ordinances setting the minimum wage higher.
    2. An employee is entitled to overtime pay whenever that person works more than 8 hours a day or 4 hours a week. Minimum wage is paid at 1 1/2 times an employee regular rate.
    3. An employee is entitled to a 10 minute paid break for every 4 hours worked, or a fraction thereof. This is a paid break, so employees don’t need to clock out.
    4. An employee is entitled to at least a 30 minute lunch break for every 5 hours worked. During this lunch break, the employee must be relieved of all duties and is free to leave the work premises.
